A few offences under the microscope

Lets have a look at two offences and examine some ways in which charges relating to them can be challenged.

Speeding

Drivers are generally caught speeding by speed cameras, of which there are many types.  The most common type is the GATSO camera – the very familiar grey box.  The problem with these cameras is the fact that the majority of them cannot actually photograph the driver driving the car, meaning it will be difficult to prove that the driver was driving the car at the time of the offence beyond “reasonable doubt”, particularly where he has evidence to show that he was elsewhere.

In addition to defences particular to GATSO cameras, for any camera, if you can show that the device was not in proper working order or calibrated, then you have a very good chance of fighting a speeding charge.

Obviously, many offenders are caught speeding by the police.  If a mobile speeding device was being used at the time, it could be argued that the device was not used according to operational guidelines.  In addition, as with any criminal offence, the police are under a duty to follow procedural rules under PACE (Police and Criminal Evidence Act) and we examine whether they were in fact followed.

Driving whilst using a mobile phone

If you are caught using a mobile phone or any other device which distracts you from driving, there is no defence; it can be argued that the use of the phone or device was absolutely essential at the time.   Whilst this is limited in scope, if you can prove that there was a genuine emergency, you have a good chance of successful challenging any charge against you.
