What is Divorce Law work?

The Basics of divorce

A divorce can only be granted if the marriage has lasted for longer than a year. The ‘petitioner’ is the person who took the first steps to file for divorce. The ‘respondent’ is the other spouse. If the couple have jointly filed for a divorce then they must decide between them who is to be known as the petitioner and respondent. The petitioner will be expected to present the case highlighting which ground or grounds are required to fulfil those specified for a divorce to be granted. The petitioner is expected to use the ground to demonstrate the ultimate point which is that the marriage has ‘irretrievably broken down’.

The proceedings could last from 3 to 6 months or possibly longer depending on the intricacy of the issues. These include how quick the respondent is in returning documents and whether there are complications in agreeing child care arrangements.

If there is irreconcilable conflict between the two parties then court attendance is recommended.
